Woman Sues City For Right To Use Sex Toys

A 2009 ordinance in Sandy Spring, Georgia – which is being challenged now in court – prohibits anyone from purchasing sex toys, unless you’ve been elected to office.
Actually the law prohibits using sex toys unless you’re a police officer or have a prescription too.
Melissa Davenport isn’t the mayor or a cop and she doesn’t have a prescription, but she still wants to use her dildo, so she’s taking the city to court.
She suffers from multiple sclerosis and has acute nerve damage and said the disease had ruined her sex life until she discovered the sex toys. Now she’s suing the city for the right to use them.
The ordinance states:
“A person commits the offense of distributing obscene material when the following occurs:
(1) He sells, rents, or leases to any person any obscene material of any description, knowing the obscene nature thereof, or offers to do so, or possesses such material with the intent to do so, provided that the word ‘knowing,’ as used in this section, shall be deemed to be either actual or constructive knowledge of the obscene contents of the subject matter.”
The exception for Mayor Rusty Paul and the police reads:
“It is an affirmative defense under this section that selling, renting, or leasing the material was done for a bona fide medical, scientific, educational, legislative, judicial, or law enforcement purpose.”
By about 2003, as the disease progressed, Davenport and her husband had almost no sex life.
“It had started to really tear us apart,” The nerve pathways interfered with the nerves going to my intimate area to where I had no feeling.”
Still, no doctor will prescribe them to her, she says.
“They have this dirty mind about how people are going to use it,” Davenport says. “People really do need devices because they need it for health reasons and to have a healthy intimate life with their spouse.”""
